Terms of Use

These terms govern your use of zko.world. By using the site you accept them. If you do not, please do not use the site.

1. Who we are

zko.world is operated by ZKO Creative Ltd (trading as ZKO Creative), a company registered in England and Wales under company number 14285845, VAT number 440 1833 27. You can reach us at hello@zko.world or on +44 754 995 0782.

2. What these terms cover

They cover your use of this website and anything you submit through it. They do not cover the work we do for clients, which is governed by the separate written agreement for each engagement. Nothing on this site is an offer to provide services on any particular terms, and no contract for our services is formed by using it.

Our Privacy Policy explains how we handle personal data and cookies, and forms part of these terms.

3. Using the site

You may browse the site, and download or print pages for your own personal or internal business reference. You must not:

• copy, reproduce, republish, distribute or exploit any part of the site for commercial purposes without our written permission;
• use any automated means to scrape, index or harvest content, other than search engines indexing publicly available pages in the usual way;
• attempt to gain unauthorised access to the site, its servers, our content management system or any connected system;
• introduce viruses, malware or any other harmful code, or carry out any attack on the site;
• use the contact or careers forms to send spam, unsolicited marketing, or anything unlawful, abusive or misleading;
• remove or alter any copyright, trade mark or other proprietary notice.

We may suspend or withdraw access to anyone who breaks these terms, and will report breaches to the relevant authorities where appropriate.

4. Intellectual property

Everything on this site is protected by copyright, trade mark and other intellectual property laws. Unless stated otherwise, ZKO Creative Ltd owns or holds a licence to the site and all of its content, including text, design, layout, source code, graphics, logos, photography, video, animation, 3D work, interactive demos and case studies. The ZKO name and mark are our trade marks.

Work we show for clients is shown with their permission to illustrate what we do. Client names, logos and trade marks remain the property of those clients, and appearing on this site gives you no right to use them.

Ownership of the work we produce for a client is set by the agreement for that project. Until any transfer of rights in that agreement takes effect, the intellectual property in our work, including concepts, drafts, pitches and proposals, stays with us. Nothing on this site transfers any rights to you.

You may link to our home page, provided you do so fairly and legally and do not suggest any association or endorsement that does not exist. You may not frame the site or embed its content elsewhere without our written permission.

5. Your submissions

Anything you send us through the site must be accurate, lawful and yours to send. By sending it you allow us to use it to respond to you and, for applications, to consider you for roles. You keep any rights in work you show us, and we will not use a portfolio or idea you send us without agreeing terms with you first.

6. Accuracy and availability

We work to keep the site accurate and up to date, but it is provided for general information and we make no promise that it is complete, correct or current. Case studies describe past projects and are not a guarantee of future results. We may change, suspend or withdraw any part of the site at any time without notice, and we do not guarantee that it will be available or free of interruption.

7. Third-party links and embedded content

The site links to and embeds content from third parties, including social networks and video platforms. Those sites and services are outside our control and have their own terms and privacy policies. A link is not an endorsement, and we are not responsible for their content.

8. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under the law of England and Wales.

Subject to that, and to the extent the law allows: the site is provided "as is" and we exclude all implied conditions, warranties and representations; we are not liable for any loss of profit, business, revenue, data, goodwill or anticipated savings, or for any indirect or consequential loss, arising from your use of or inability to use the site or your reliance on anything it contains; and we are not liable for loss caused by viruses or other harmful material that may infect your equipment through your use of the site or anything linked from it. You are responsible for your own virus protection.

If you are a consumer, nothing here affects your statutory rights. If you use the site for business, you agree that these terms contain the whole agreement between us about the site, and that you have not relied on any statement not set out in them.

9. Changes to these terms

We may revise these terms from time to time. The version on this page is the current one, and the date at the top shows when it last changed. Continuing to use the site after a change means you accept the revised terms.

10. Governing law

These terms, their subject matter and their formation are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your local courts.
